1. Who We Are and What This Policy Covers
XLOAD LLC ("XLoad", "we", "us", "our"), a Delaware limited liability company with its address at 3225 McLeod Dr, STE 100, Las Vegas, NV 89121, provides the XLoad platform.
This Privacy Policy explains what personal information we collect, why we collect it, who we share it with, and what choices you have. It covers:
- the website at xload.com;
- the web application at app.xload.com;
- the XLoad Driver mobile applications for iOS and Android;
- the tokenized web pages we send by email or text message, such as the form on which a carrier submits driver and vehicle details; and
- our email, text message, and push notification communications.
Together these are the "Service". Your use of the Service is also governed by our Terms of Service.
If you do not agree with this policy, please do not use the Service. If you have questions, contact us at support@xload.com.
2. How the Service Works, and Why That Matters Here
XLoad is an operational software tool for freight brokerages and the carriers and drivers they work with. Understanding two things about how it works explains most of the data flows in this policy.
There is no open sign-up. You cannot create an XLoad account for yourself. Every account and every grant of access is created by a brokerage, or by a carrier acting under its agreement with a brokerage, on the basis of an existing contract or working relationship. We do not recruit or enrol users on our own initiative.
Information usually reaches us through an organization. If you are a driver, the brokerage or carrier that engaged you typically provides your name, mobile phone number, and email address so that we can notify you about a load. That organization is contractually required to have your consent before doing so.
3. Our Role: We Are an Intermediary
This section explains something that applies to almost everything in this policy, so it is worth reading before the rest.
For personal information that flows through the Service about drivers, carrier contacts, and shipments, XLoad acts only as an intermediary. The brokerage or carrier is the party that decides what information is collected, why it is collected, who may see it, and how long it is kept. It does so under its own contracts — its broker-carrier agreement, its carrier-driver agreement, its employment or contractor agreements — to which XLoad is not a party. We supply the software that carries the information and store it on that organization's behalf.
In the language of US state privacy laws, the brokerage or carrier is the controller (in California, the "business"), and XLoad is its service provider or processor. We handle that information only on their documented instructions and only to provide the Service. We do not decide to collect it, we do not use it for our own purposes, and we do not sell or share it.
For a narrow set of information we collect in our own right — website visitors, account administration and authentication, security and abuse prevention, and our own communications with you — we act as the controller and this policy describes our own practices.
What this means for you. If you are a driver or a carrier contact and you want information corrected or deleted, contact us and we will help, but in most cases we must refer your request to the organization that collected it, because the decision is theirs to make. If you disagree with what an organization asks you to provide, or with how it uses what you provided, that is a matter between you and that organization under your agreement with them.
4. Information We Collect
Read this section together with Section 3. Except where stated otherwise, we collect and store everything below as an intermediary, on behalf of the brokerage or carrier you work with. That organization determines what is collected and why, under its underlying agreements with you; we hold it on their behalf and act on their instructions.
4.1 Information you or your organization provides
- Identity and contact information — name, mobile phone number, email address, job title, and the organization you belong to.
- Driver and vehicle details submitted for a shipment — driver name, mobile phone number, and email address, together with vehicle number, vehicle type, trailer number and type where applicable, and licence plate number. This is commonly submitted by a carrier contact rather than by the driver personally.
- Account credentials — passwords are stored in hashed form; we never store them in a form we can read.
- Shipment records — pickup and delivery locations, dates and times, quantities, weights, mileage, status changes, and the amounts your organization records against a load.
- Documents and photographs — bills of lading, proofs of delivery, and other paperwork or photographs uploaded in connection with a shipment.
- Messages — content you send through shipment chat, and correspondence with our support team.
Driver onboarding applications. Drivers who are onboarded as company drivers, owner operators, or independent service providers complete an application that collects considerably more than the details above.
The application is not ours. The brokerage or carrier onboarding you decides what it asks, in order to qualify, insure, and pay you under your agreement with them. XLoad provides the form and stores the answers as an intermediary; we do not assess or approve applications, and we do not use the answers for our own purposes.
Depending on driver type and answers, it can include:
- Personal — legal name, home address, date of birth, phone numbers, email, citizenship, driving experience, self-reported accident and violation history, and an emergency contact's name, phone, and relationship. Please tell that person you gave us their details.
- Identity documents — driver's licence images, number, issuing state and expiry; a photograph of you and of you holding your licence; TWIC card where held.
- Vehicle — registration, VIN, plates, specifications and photographs, insurance certificate and policy details, and ownership or authorization documents.
- Payment — payee name and address, settlement email, payment method, and a W-9 or factoring notice plus a banking setup form. A W-9 carries a taxpayer identification number, which for a sole proprietor is a Social Security number; a banking form carries account details.
How documents are read. We run text recognition on uploaded licences, registrations, and insurance documents to pre-fill fields, and show you the result so you can correct it. It reads printed text only: no facial recognition, face matching, or liveness detection, and no biometric template or faceprint is created.
4.2 Information we collect automatically
- Device and application information — device type, operating system version, application version, and mobile push notification tokens.
- Log and usage information — IP address, access times, pages and screens viewed, and actions taken in the Service, including the audit trail of changes made to a shipment.
- Location information — see Section 5.
- Cookies and similar technologies — see Section 9.
4.3 Information we receive from other people
We receive personal information about drivers and carrier contacts from the brokerages and carriers that engage them, as described in Section 2.
We do not buy, rent, licence, append, or otherwise obtain personal information from data brokers, list vendors, lead providers, marketing partners, affiliate programmes, or social media platforms. We do not collect personal information from public databases for marketing purposes.
4.4 Information we do not collect
We do not collect, process, or store payment card information. The Service is free of charge, there is no checkout, and we have no facility to accept a debit or credit card number. If anyone asks you for card details in the name of XLoad, it is not us — please report it to support@xload.com.
We also do not collect health or medical information, biometric templates or faceprints, credit reports or credit scores, or information about your race, religion, political opinions, sexual orientation, or union membership. We do not run background checks, pull motor vehicle records, or query third-party safety databases about you.
4.5 Sensitive information
Driver onboarding necessarily involves sensitive personal information. Where it applies to you, we may hold the following as an intermediary for the brokerage or carrier that requested it — in each case that organization, not XLoad, decided it was needed:
- Precise geolocation, for drivers operating an active shipment (see Section 5);
- Driver's licence number and images, and TWIC card details where you hold one;
- A taxpayer identification number, which for a sole proprietor is a Social Security number, contained in a W-9 you upload;
- Financial account details, contained in a banking or payment setup form you upload;
- Citizenship, and date of birth, collected because carriers and brokerages must confirm eligibility for particular loads, including cross-border work; and
- Photographs of your face, including a photograph of you holding your driver's licence, used so the organization engaging you can confirm you are who you say you are.
We use sensitive personal information only for the purposes for which you provided it — verifying identity and eligibility, enabling settlement, and operating shipments — and only as directed by the organization on whose behalf we hold it. We do not use or disclose it to infer characteristics about you, we do not use it for advertising, and we do not sell it. You may ask us to limit its use as described in Section 13.
5. Location Information
When we collect it
The XLoad Driver application collects the device's location while a driver is operating an active shipment. Collection requires you to grant the operating system location permission to the application.
Why we collect it
To show the brokerage and carrier organizations involved in a shipment where the load is, so they can plan pickups and deliveries and answer their customers. We collect it as an intermediary for those organizations. Tracking is a requirement they impose under their agreement with you; XLoad does not track drivers for its own purposes and makes no use of location data beyond displaying it to them and storing it on the shipment record.
Who can see it
The organizations participating in that shipment, and our personnel where necessary to operate or support the Service.
How to stop it
You can withdraw location permission at any time in your device settings. If you do, the application will indicate that tracking is unavailable. This may affect obligations you have under your own agreement with the carrier or brokerage that engaged you, but it is a choice that remains yours to make.
What it is not
XLoad is not an electronic logging device and is not certified as one. Location data in the Service is not designed for, and must not be relied on for, hours-of-service compliance. Any use of it by a brokerage or carrier for employment, compensation, or disciplinary purposes is that organization's decision and responsibility, not ours.
Retention
Location points collected during a shipment are retained as part of that shipment record. We do not track drivers between shipments.
6. Mobile Phone Numbers and Text Messages
This section describes how we handle mobile phone numbers and text messaging consent. It is the counterpart to Section 9 of our Terms of Service.
6.1 What we use your mobile number for
We use mobile phone numbers to send operational, transactional text messages only — telling a driver that a load has been assigned to them, delivering the link or credentials needed to access the Driver application and begin tracking that load, and sending authentication messages such as one-time credentials and password resets.
We do not send marketing, advertising, or promotional text messages.
6.2 How we obtain consent
Either you provide your mobile number to the brokerage or carrier onboarding you, and are told at that time what messages you will receive and how to stop them, or the organization that assigns you to a load submits your number and confirms to us that you have agreed to receive XLoad messages about that shipment. There is no other route by which a number enters the Service.
6.3 We do not share your mobile information
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
Text messaging originator opt-in data and consent are not shared with any third party, other than the messaging aggregators and telecommunications providers that transmit the messages on our behalf, and only for the purpose of delivering them. Sharing with subcontractors that provide support services to us, such as customer support, is permitted for that purpose alone.
We never sell, rent, lease, or trade mobile phone numbers, messaging consent, or message content.
6.4 How to stop receiving text messages
Reply STOP to any message from us. You may also reply CANCEL, END, QUIT, UNSUBSCRIBE, or OPTOUT. You will receive one confirmation and no further messages.
Because we send from a toll-free number, the opt-out is applied by the mobile carriers at network level. We cannot override it or turn messages back on for you. To resume, text START or UNSTOP to the same number yourself.
Message frequency varies with shipment activity; most recipients receive a single message per shipment. Message and data rates may apply. For help, reply HELP, email support@xload.com, or call +1 (803) 408-4454.
Assignment notifications and access links are also sent by email, so opting out of text messages does not by itself remove your access to the Service.
7. How We Use Information
We use personal information to:
- provide, operate, and maintain the Service;
- create and administer accounts and shipment-scoped access, and authenticate users;
- deliver operational notifications by text message, email, and push notification;
- display shipment progress and location to the organizations involved in a shipment;
- store and make available shipment documents, photographs, and messages;
- respond to support requests and communicate with you about the Service;
- monitor, secure, and troubleshoot the Service, and detect and prevent fraud, abuse, and unauthorized access;
- produce aggregated and de-identified statistics that do not identify you or any individual; and
- comply with law and enforce our Terms of Service.
We do not use personal information for targeted advertising, and we do not carry out profiling that produces legal or similarly significant effects.
8. How We Share Information
Because XLoad holds most information as an intermediary (Section 3), the first two items below are less "sharing" than making information available to the organizations it belongs to.
With the organizations involved in your shipment. Information about a shipment, including driver and vehicle details, status updates, location, documents, and chat messages, is visible to the brokerage and carrier organizations participating in that shipment. This is the core purpose of the Service.
With the organization that onboarded you. If you completed a driver onboarding application, the brokerage or carrier reviewing your application can see what you submitted, including your identity and credential documents, vehicle and insurance documents, and settlement details. That organization decides whether to approve you, and it uses those documents for its own qualification, insurance, and payment purposes.
With service providers acting on our behalf. We use vendors to run the Service, including cloud hosting and infrastructure, text message and email delivery, mobile push notification, mapping and geocoding, and error monitoring and analytics. They may process personal information only to provide services to us, under contract, and may not use it for their own purposes. Our infrastructure is hosted in the United States.
For legal and safety reasons. We may disclose information where we believe in good faith that it is required by law, subpoena, or other legal process, or is necessary to protect the rights, property, or safety of XLoad, our users, or the public, or to investigate suspected fraud or a violation of our Terms of Service.
In a business transfer. If we are involved in a merger, acquisition, financing, or sale of assets, information may be transferred as part of that transaction. We will require the recipient to honour this policy or give you notice of any change.
What we never do. We do not sell personal information, and we do not share it for cross-context behavioural advertising or targeted advertising, as those terms are defined under US state privacy laws. We have not sold or shared personal information for those purposes in the preceding twelve months, and we have no plans to.
9. Cookies and Similar Technologies
We use strictly necessary cookies only. On xload.com and app.xload.com, cookies and similar technologies are used to keep you signed in, maintain your session, and protect against fraud and abuse. The Service does not work without them.
We do not use analytics, advertising, retargeting, or cross-site tracking cookies, and we do not allow third parties to place tracking technologies on the Service for their own purposes. Because we set no optional cookies, there is nothing here for you to opt out of.
Most browsers accept cookies by default and let you remove or reject them. Rejecting our cookies will prevent parts of the Service from working.
10. How Long We Keep Information
Where we hold information as an intermediary, the brokerage or carrier decides how long it is kept, within the limits of our agreement with them and applicable law. The periods below describe our default practice:

We may keep information longer where a longer period is required by law, or where it is needed to resolve a dispute, enforce our agreements, or defend a legal claim. Opt-out records are deliberately retained after account closure, because deleting them would risk texting someone who has asked us not to.
You are responsible for keeping your own copies of records you are required to retain. We are not a records-retention service.
11. How We Protect Information
We use technical and organizational measures designed to protect personal information.
All data travelling between your device and the Service is encrypted in transit. Every connection to our website, web application, and mobile applications uses an encrypted channel, so the information you submit — including the documents you upload during onboarding — cannot be read as it crosses the network. We also apply hashed password storage, access controls and per-organization permissioning, and logging of changes to shipment records.
No method of transmission or storage is completely secure, and we cannot guarantee absolute security. Keep your credentials confidential, do not share tokenized links we send you, and tell us at support@xload.com if you suspect unauthorized access to your account.
12. Children
The Service is a business tool intended for users aged 18 and over. We do not knowingly collect personal information from children under 18, and we do not market to them. If we learn that we hold information from someone under 18, we will delete it. If you believe a child has provided us information, contact support@xload.com.
13. Your Privacy Rights
13.1 US state privacy rights
If you are a resident of a state with a comprehensive privacy law — including California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, and Virginia — you may have the right to:
- confirm whether we process your personal information, and access it;
- obtain a copy of the information you provided to us, in a portable format;
- correct inaccuracies;
- request deletion;
- opt out of sale, targeted advertising, and profiling with legal or similarly significant effects — none of which we do;
- limit the use of sensitive personal information;
- obtain a list of the categories of third parties to which we have disclosed personal information; and
- not be discriminated against for exercising any of these rights.
13.2 Categories of information we collect, in state-law terms

We collect these from you, from the organization that engaged you, and automatically from your device. We use and disclose them for the purposes in Sections 7 and 8.
13.3 How to exercise your rights
Email support@xload.com from the address associated with your account, or write to us at the address in Section 16. We will verify your identity before acting, and we may ask for additional information for that purpose only. An authorized agent may act for you with proof of authorization.
We will respond within the time required by applicable law. If we decline your request, you may appeal by replying to our decision; if the appeal is denied, you may complain to your state attorney general.
Where the information belongs to a brokerage or carrier account, we will refer your request to that organization and support them in responding.
13.4 Global Privacy Control
We honour the Global Privacy Control (GPC) signal where applicable law requires it. Because we do not sell personal information or use it for targeted advertising, there is little for the signal to switch off.
13.5 California Shine the Light
California Civil Code Section 1798.83 lets California residents request details of personal information disclosed to third parties for their direct marketing purposes. We make no such disclosures.
13.6 EEA, UK, and Switzerland
The Service is offered from and intended for use in the United States. If you visit our website from the EEA, UK, or Switzerland, we process your information on the basis of our legitimate interest in operating and securing the website, your consent where required for non-essential cookies, and to comply with legal obligations. You have rights of access, rectification, erasure, restriction, portability, and objection, and may complain to your local supervisory authority.
14. Do Not Track
There is still no uniform standard for Do Not Track browser signals, and we do not respond to them. We do honour the Global Privacy Control as described in Section 13.4. California law requires us to disclose this.
15. Changes to This Policy
We may update this policy. The current version is always posted at https://xload.com/privacy-policy with the effective date at the top. If we make material changes, we will give notice by posting prominently on the website, by in-application notice, or by email. Continued use of the Service after the effective date means you accept the updated policy.
